Terms of Service

These terms govern your use of PrairieDogginIt (the "service"), operated by Joseph Sands / JArch Designs. By creating an account or using the service you agree to these terms.

Your account

  • You must be at least 13 years old.
  • You're responsible for activity under your account. Keep your credentials private and tell us if you suspect unauthorized access.
  • We may suspend or terminate accounts that violate these terms, with or without notice, especially for abuse, spam, or illegal activity.

Your content

You keep ownership of the content you post (listings, photos, reviews, comments). By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote that content as part of the service. The license ends for content you delete, except for content others have incorporated into their own use (e.g., screenshots, copies they saved).

You confirm that you have the right to post what you post, and that it doesn't violate anyone else's rights.

Acceptable use

Don't:

  • Post spam, harassment, hate speech, sexual content, or illegal content.
  • Impersonate other people or businesses.
  • Submit inaccurate listings on purpose, or flood the system with fake reviews.
  • Scrape the service, attempt to break it, or reverse-engineer it.
  • Use the service to infringe on other people's privacy, including posting their address or photos of them without consent.

Moderation

We reserve the right (but are not obligated) to remove or edit content, restrict features, or ban accounts. Flags submitted by users are reviewed by humans on our side, not acted on automatically.

Paid features

Some features (e.g., No Ads Forever, Premium and Elite subscriptions, paid-access listings, listing setup fees) are paid. We don't store your card details ourselves; payments are handled by one of three processors depending on platform and product:

  • Stripe (web purchases of any kind, and all paid-listing entry / annual permit purchases on every platform). Subject to Stripe's own terms. For paid-listing entry and permit purchases, the listing owner — not PrairieDogginIt — is the merchant of record. You are buying access from that owner. We provide the platform and payment routing through Stripe Connect and retain a percentage fee; the balance settles to the owner's own Stripe account. Because the owner is the merchant, the charge on your card statement may appear under their business name rather than ours.
  • Apple In-App Purchase (No Ads, Premium, and Elite subscriptions purchased from the iOS app). Subject to Apple's Media Services Terms. Refunds for IAP go through Apple at reportaproblem.apple.com; we cannot directly refund an Apple-billed subscription.
  • Google Play Billing (No Ads, Premium, and Elite subscriptions purchased from the Android app, when available). Subject to Google's Play Billing terms. Refund requests go through Google Play; we cannot directly refund a Google-billed subscription.

Subscriptions auto-renew until cancelled in the same store you bought them through (App Store → Subscriptions, or Google Play → Subscriptions). Paid features are non-transferable between accounts.

For Stripe-billed purchases sold by us — subscriptions and listing setup fees — refunds are handled case-by-case; email noreply@prairiedogginit.com within 14 days if you have an issue. Listing setup fees are non-refundable.

Paid-listing entry and permit purchases are sold by the listing owner, and refunds are their decision. Contact the owner first through the app. If they agree a refund is warranted, we process it through Stripe on their behalf and recover it from their proceeds — the cost of the refund falls on the owner, not on us. We may also issue a refund at our sole discretion (for example, where a listing was misrepresented or inaccessible), on the same basis. We cannot compel an owner to agree to a refund, and we are not obliged to cover one ourselves.

Entry and permit purchases are otherwise final once the access code or QR code has been issued to you, since that is the moment you receive what you paid for. Nothing here limits any statutory consumer right you have under the law of your country of residence.

Use of physical listings (assumption of risk)

Listings on PrairieDogginIt describe real-world locations maintained by other users or third parties. Visiting any listing is at your own risk. PrairieDogginIt is a directory and a payment intermediary; we do not own, operate, inspect, or supervise any listing.

By using a listing — paid or free — you assume all risks of doing so, including but not limited to: slips, falls, exposure to unsanitary conditions, contact with animals, theft of personal items, allergic reactions, and any injury, property damage, or loss arising from the condition of the location or the conduct of others present. You agree that PrairieDogginIt is not liable for any of the foregoing.

You are responsible for following all local laws, property rules, and the listing owner's posted rules. If a listing requires permission or a code to access, do not enter without it.

Dogs, dog parks & animal interactions (assumption of risk & release)

PrairieDogginIt lists dog parks and other places where dogs and other animals are present. Dogs are unpredictable. Any dog — including another visitor's dog, a resident dog, or a dog with no known history of aggression — can bite, attack, injure, knock down, or transmit disease to people or other animals. Entering a dog park, or bringing or interacting with any animal at a listing, is done entirely at your own risk.

You expressly assume all risks arising from dogs and other animals, including bites, attacks, scratches, knock-downs, disease, and any injury, death, or property damage — whether to you, to your own dog, or caused by your own dog to another person or animal. You are solely responsible for your own dog at all times: its behavior, supervision, restraint, and vaccination, and any harm it causes. You agree to obey all posted rules and all local leash, vaccination, and animal-control laws.

To the fullest extent permitted by applicable law, you release, waive, discharge, and agree not to sue both (a) PrairieDogginIt / JArch Designs and (b) the owner or operator of any listing you visit — together with their respective operators, employees, agents, and affiliates — from any and all claims, demands, injuries, damages, losses, or expenses arising out of or related to a dog or animal bite, attack, or interaction, the acts of another visitor or their animal, or the condition of the location, including claims based on ordinary negligence, strict liability, or any statutory or common-law animal-liability rule of any U.S. state or country that applies to you (for example, Minnesota's dog-owner liability statute, Minn. Stat. § 347.22, and comparable dog-bite or strict-liability laws in other states, such as California Civil Code § 3342 or Florida Statutes § 767.04). Neither PrairieDogginIt nor the listing owner supervises, controls, screens, or is responsible for the animals or the people present at any location, or for the temperament or behavior of any dog.

The owner or operator of a listing is an intended third-party beneficiary of the release and the indemnity in these terms and may enforce them directly. This release does not apply to liability that cannot be waived or excluded under the law that applies to you (for example, some jurisdictions do not permit the exclusion of liability for death or personal injury caused by negligence, or for gross negligence or willful misconduct).

Minors. If you bring or permit a minor to use or enter a listing, you represent that you are their parent or legal guardian (or are otherwise authorized to act for them), and you accept these terms — including the assumption of risk, release, and indemnity above — on the minor's behalf, assume all risks to the minor, and agree to supervise them at all times. Because an online agreement alone may not bind a minor's own claims in every jurisdiction, owners of monetized listings should also obtain a parent- or guardian-signed waiver on site.

Treating listings with care (damages)

When you visit a listing — especially a paid one — you agree to leave it in the same condition you found it (or better). Don't damage property, mistreat animals, or leave a mess for the next visitor.

We do not store your card and cannot charge you after the fact. If a listing owner reports verifiable damage caused by your visit, the owner may pursue you directly for the documented cost of repairs or cleaning, in addition to any access fee already paid — you bought access from them, and any damage claim is between you and them. We may assist in coordinating a claim on a best-effort basis, and we may suspend or remove an account over credible damage reports. Email noreply@prairiedogginit.com if you want to contest a report.

Listing owner responsibilities (paid listings)

If you operate a paid listing, you agree that you:

  • Have the legal right to grant access to the location at the price and hours you advertise.
  • Will keep the location reasonably clean, accessible, and safe during paid hours, and will accurately describe its condition.
  • Are solely responsible for compliance with local laws (zoning, health codes, accessibility, taxation), and for reporting income received through the platform — Stripe issues a 1099-K when you cross their reporting threshold.
  • Will honor valid tickets and not deny access to a paid visitor without a documented good-faith reason (e.g., the visitor is damaging the location or violating posted rules).
  • Acknowledge that the setup fee is non-refundable, and that PrairieDogginIt and Stripe each take a per-purchase fee as disclosed in the monetization flow.
  • Are the merchant of record on every sale. Entry and permit purchases are processed through Stripe Connect with you as the settlement merchant, which means: Stripe's payment processing fee is deducted from your proceeds; PrairieDogginIt retains its percentage fee from the remainder; and the cost of any refund, chargeback, or card dispute — including any dispute fee charged by Stripe — falls on you, not on us. Card disputes are resolved against your Stripe account and you are the party who responds to them. Refunds are processed by us through Stripe and recovered from your proceeds. A refunded or disputed sale can therefore leave you net-negative on that transaction. Accurate listing descriptions, honest hours, and working access codes are your best protection.
  • Will not use the platform to harass, discriminate against, or collect identifying information from visitors beyond what is needed to verify their ticket.
  • Carry liability insurance. If your listing is monetized, you must maintain commercial general liability insurance that includes animal / dog-bite coverage, name JArch Designs / PrairieDogginIt as an additional insured, and provide a certificate on request (we strongly recommend the same for free listings). You should also post assumption-of-risk signage at each entrance and, where practical, obtain a signed on-site waiver from every entrant. Any resident or owned dog kept on the premises must be leashed, separated, or kept off-premises during public hours.

A listing owner's responsibility for safety is limited to the reasonable condition of the physical premises. Owners do not supervise, control, or warrant the behavior of dogs or other animals brought by visitors, or the conduct of visitors themselves, and are released from and indemnified against claims arising from them as set out in the "Dogs, dog parks & animal interactions" and "Indemnification" sections.

Disputes between users

PrairieDogginIt is not a party to any dispute between a visitor and a listing owner. If you have a problem with a listing, please first try to resolve it directly with the owner. If that fails, email noreply@prairiedogginit.com and we'll review on a best-effort basis. We may, at our sole discretion, refund a visitor (recovering it from the owner's proceeds, as described under Paid features) or remove a listing — but we are under no obligation to do so.

Nothing here affects your right to dispute a charge with your bank or card issuer. Because the listing owner is the merchant on entry and permit purchases, a card dispute is resolved against that owner, and the disputed amount and any dispute fee charged by Stripe are debited from their account. We are not a party to that process and do not guarantee its outcome. We'd simply ask that you contact the owner first — most problems are quicker to fix that way.

Indemnification

You agree to defend, indemnify, and hold harmless JArch Designs and the owner or operator of any listing you visit, along with their respective operators, employees, agents, and affiliates, from any claim, demand, loss, liability, damage, judgment, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service or any listing; (b) content you post; (c) your violation of these terms or any law; (d) your interaction with other users; or (e) the acts, behavior, temperament, or condition of any dog or animal you bring to, own, or control at a listing, including any injury or damage it causes to any person or animal. This indemnity does not apply to the extent a loss is caused by the indemnified party's own gross negligence or willful misconduct, or where such indemnity is prohibited by mandatory consumer-protection law that applies to you.

Disclaimers

PrairieDogginIt is provided as-is. User-submitted listings may be inaccurate, out of date, or outright wrong. We make no warranty that any listing is actually open, safe, clean, legal to access, or exists at all. You use the information at your own risk and must follow local laws and property rules.

We don't guarantee uninterrupted service. Data can be lost due to bugs, outages, or provider failures.

Limitation of liability

To the maximum extent allowed by law, JArch Designs and its operators are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is greater.

Termination

You can delete your account at any time — email noreply@prairiedogginit.com to start the process. We can suspend or terminate your access if we believe you've violated these terms.

Changes

We'll post updates to these terms on this page. Material changes get a banner or email. Continuing to use the service after a change means you accept the new terms.

Severability & reformation

If any provision of these terms — or its application to a particular person, dog, or claim — is held unenforceable, that provision will be reformed only to the minimum extent needed to make it enforceable, or if it cannot be, severed, and the remaining provisions stay in full force. The releases, waivers, and indemnities in these terms are intended to be given the broadest effect the applicable law allows, and to be read down rather than voided where a jurisdiction limits them.

Governing law

These terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-laws rules. Disputes go to courts located in Dakota County, Minnesota.

If you are a consumer resident in the EEA, the UK, or another jurisdiction whose law grants you mandatory protections or the right to bring proceedings in your local courts, nothing in these terms deprives you of those protections or that right, and the choice of Minnesota law and forum applies only to the extent that law permits.
